Terms of Service

In these Terms of Service, the following terms have the meanings set out below:

• "Otzoo" / "Company" / "We" / "Us" — the Otzoo platform and its operators, based in Dehradun, Uttarakhand, India.
• "Application" / "App" — the OTZOO Android application and all associated services including OTZOO Energy.
• "User" — any person who downloads, installs, or uses the Otzoo application.
• "Business Owner" — a User who registers a business listing on the platform.
• "Subscription" — a paid plan purchased by a Business Owner to access premium listing features.
• "Growth Partner" — an approved individual who participates in the Otzoo Growth Partner Program.
• "OTZOO Energy" — OTZOO's EV charging platform, including station discovery, slot booking, Host Your Charger, and route planner.
• "EV Station" — an electric vehicle charging station listed on OTZOO, sourced from Open Charge Map, government datasets, CPO partners, or host registrations.
• "Charging Slot" — a reserved time period at an EV station booked by a User through the OTZOO app.
• "Host Charger" — a private EV charger registered by a homeowner or individual on OTZOO Energy for peer-to-peer charging.
• "Host" — a User who registers their personal EV charger on OTZOO Energy via the "Earn From Your Charger" feature.
• "Booking User" — a User who books a Charging Slot at a station or Host Charger.
• "Reliability Score" — a 0–100 community-driven trust score calculated for each EV station based on user verifications, reviews, and session success rates.
• "CPO" — Charge Point Operator; a commercial EV charging network partner (e.g. Pulse Energy, Statiq, Tata Power EV).
• "OCPI" — Open Charge Point Interface, version 2.2.1, the technical protocol used by OTZOO to integrate with CPO partners.
• "Content" — any text, images, business information, or other material uploaded or shared by Users.

By accessing or using the Otzoo application, you confirm that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding contract
• You have read and understood these Terms of Service and our Privacy Policy
• You agree to be legally bound by these terms
• You will comply with all applicable local, state, national, and international laws
• ⚡ For Host Charger registration: you own or have explicit permission to use and share the charger listed

To use Otzoo, you must create an account using Google Sign-In. By registering, you agree to:

• Provide accurate, complete, and current information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorised access to your account
• Take full responsibility for all activity that occurs under your account
• Not create multiple accounts or share your account with others
• ⚡ Not create fake accounts to generate fraudulent EV charging verifications or Host Charger bookings

Otzoo offers the following annual subscription plans for Business Owners:

Payments are processed securely by Razorpay & Cashfree.

• All paid subscriptions are valid for one (1) calendar year from the date of activation
• Subscriptions do not auto-renew — you must manually renew before expiry
• Upon expiry, your account will revert to the Free plan automatically — your listing data will be retained
• Otzoo reserves the right to modify subscription pricing with at least 30 days' advance notice

Business Owners may create listings on Otzoo subject to the following conditions:

• All listing information must be accurate, truthful, and kept up to date
• You must have the legal right to list and operate the business described
• Listing content must not be misleading, defamatory, or violate any third-party rights
• Adult content, illegal services, or prohibited goods may not be listed on Otzoo

By uploading content to Otzoo, you grant Otzoo a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content within the application.

The Otzoo Growth Partner Program allows approved individuals to earn commissions by referring businesses to subscribe to paid Otzoo plans.

9.1 Eligibility

• Applicants must be at least 18 years of age with a valid bank account
• Valid government-issued identity proof is required
• Otzoo reserves the sole right to approve or reject any application

9.3 Payout Policy

• Minimum payout threshold: ₹500
• Payouts processed within 3–5 business days of admin approval
• Payouts transferred only to the bank account registered at application
• Otzoo reserves the right to withhold payouts pending fraud investigation

The following activities are strictly prohibited across all OTZOO features:

• Self-referrals or fake account creation for fraudulent commissions
• Submitting false EV station verifications to manipulate Reliability Scores
• Creating fake EV charging bookings to generate fraudulent host earnings
• Misusing or storing car verification documents submitted by Booking Users
• Listing EV chargers you do not own or have permission to use
• Bypassing OTZOO's payment system for host charger sessions to avoid platform commission
• Uploading or sharing illegal, defamatory, obscene, or harmful content
• Using automated bots or scrapers to extract data without written permission
• Reverse-engineering or decompiling any part of the application
• Violating any applicable local, national, or international laws

Otzoo reserves the right to suspend or permanently terminate any account at its sole discretion, including for:

• Violation of any provision of these Terms of Service
• Fraudulent activity, misrepresentation, or provision of false information
• ⚡ False EV station verifications or fake booking abuse
• ⚡ Misuse of car verification data by a Host
• ⚡ Repeated booking cancellations or unavailability as a Host without valid reason
• Abusive conduct towards Otzoo staff or other users
• Legal requirements or court orders

All intellectual property rights in the Otzoo application — including OTZOO Energy, the Reliability Score system, Host Your Charger platform, and OCPI/Beckn integration architecture — are owned exclusively by Otzoo. Nothing in these Terms grants you any right to use Otzoo's intellectual property without express written permission.

⚡ EV station data sourced from Open Charge Map is licensed under Creative Commons Attribution 4.0 International (CC BY 4.0). Government EV data is public domain. OTZOO's proprietary additions (Reliability Score, community verifications, host network) remain OTZOO's intellectual property.

The Otzoo application is provided on an "as is" and "as available" basis, without warranties of any kind. This includes:

• ⚡ No guarantee that any EV station listed will be operational, available, or compatible with your vehicle when you arrive
• ⚡ No guarantee of route planner accuracy or charging stop availability for long-distance journeys
• ⚡ No guarantee that CPO partner (Pulse Energy, Statiq, etc.) integrations will be uninterrupted
• ⚡ No guarantee that Host Charger sessions will complete without technical issues
• No guarantee of specific commission earnings for Growth Partners
• No warranty of uninterrupted, error-free, or secure operation of the platform

To the maximum extent permitted by applicable law, Otzoo shall not be liable for:

• ⚡ Any damage to your vehicle, battery, or electrical systems arising from use of any EV station listed on OTZOO
• ⚡ Any injury, property damage, or loss arising from host charger use
• ⚡ Range anxiety, breakdowns, or accidents arising from reliance on OTZOO's route planner or station data
• ⚡ Session interruptions or failures caused by CPO partner network issues
• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Actions taken by third-party payment processors or banks

In no event shall OTZOO's total liability exceed the amount you paid to OTZOO in the 3 months immediately preceding the event giving rise to the claim.

15.1 Informal Resolution: Contact otzooofficial@gmail.com first. OTZOO will respond within 30 days.

15.2 EV Charging Disputes: For disputes regarding EV booking payments, Host Charger earnings, or station reliability scores — contact us within 7 days of the incident. OTZOO's internal decision is final at platform level.

15.3 Governing Law: These Terms are governed by the laws of India, specifically Uttarakhand. Disputes shall be subject to the exclusive jurisdiction of courts in Dehradun, Uttarakhand, India.

Otzoo reserves the right to modify these Terms at any time. We will notify you at least 7 days before material changes take effect. For changes to EV charging fees, Host commission rates, or Growth Partner commission structure, we will provide at least 30 days' advance notice.

This document was updated in July 2026 to include OTZOO Energy EV Charging terms, Host Your Charger program terms, car verification data terms, OCPI/Beckn protocol terms, and related liability disclaimers.

• Severability: If any provision is found invalid, remaining provisions continue in full force.
• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Otzoo.
• Waiver: Failure to enforce any right shall not be deemed a waiver.
• Assignment: You may not assign your rights without OTZOO's prior written consent.
• Force Majeure: OTZOO shall not be liable for failures due to causes beyond its control — including CPO network outages, government EV policy changes, or power grid failures.
• Language: These Terms are prepared in English. In case of conflict, the English version shall prevail.
